104 - Acceptable Use Policy

1.0 Purpose

彩神vlll争霸 encourages the use of its information resources as a way to create and share information and knowledge in support of its three-part mission of teaching, research and service. This policy summarizes, and where applicable, outlines 彩神vlll争霸鈥檚 specific rules and procedures for appropriate use of information resources. Users will be held to the terms and conditions outlined in both this policy and UA Board of Regent鈥檚 (BOR) Information Resources Policy (see Section 3.0 below). Where apparent conflict between these policies arises, BOR policy and regulation will take precedence.

2.0 Standard

2.1 Use of Information Resources

Users agree to use 彩神vlll争霸鈥檚 information resources ind accordance with all applicable laws and under terms of use outlined in information resources policy and regulation (see Section 3.0 below). Users agree that they will not use any information resource to transmit or post the following content:

  1. Content that does not clearly identify the author or defames or threatens others;
  2. Statements that are bigoted, hateful or racially offensive;
  3. Content that discusses illegal activities with the intent to commit them;
  4. Content that infringes another鈥檚 intellectual property, including but not limited to, copyrights, trademarks or trade secrets;
  5. Material that contains vulgar or obscene language or images;
  6. Advertising or any form of commercial solicitation;
  7. Content related to partisan political activities;
  8. Excessive or unsolicited electronic mail;
  9. Copyrighted material, including without limitation software, graphics, text, photographs, sound, video and musical recordings without the express permission of the owner of the copyright in the material, or other legal entitlement to use the material (DMCA, Pub. L., No. 105-304, 112 Stat. 2860 [Oct. 28, 1998]).

Additionally, users further agree that they will not:

  1. Access or attempt to access any other user鈥檚 account/information without permission, or misrepresent or attempt to misrepresent their identity while using 彩神vlll争霸鈥檚 information resources
  2. Engage in the disproportionate use of information resources that creates a debilitating effect on information resources available to other users.

2.2 Limitation of Use

Users may use 彩神vlll争霸's information resources for appropriate legal purposes only. Furthermore, users agree that, if a third party claims that any material posted by a user is unlawful, that the user will bear the burden of establishing that the material complies with all applicable laws. Although 彩神vlll争霸 does not regularly monitor use of information resources, it reserves the right to move material from websites, block access or take other action with respect to the material at its sole discretion. 

3.0 Procedures

Violations of this policy should be immediately reported by contacting the Technical Support Center at 786-4646 or contact the Office of the Chief Information Officer. All reported violations will be investigated immediately and may result in disciplinary action, dismissal (students or employees) or temporary/permanent denial of access to information resources, or referral for criminal prosecution.
